BEING DUE AND PAYABLE WHEN POSSESSION IS TAKEN, OR BEFORE PUPPY IS SHIPPED. ALL SHIPPING CHARGES ARE PAID BY THE BUYER. DEPOSITS ARE NON-REFUNDABLE
 

THE PARTIES HERETO AGREE AS FOLLOWS;
 

1. The puppy covered by this contract is being sold in a co-ownership agreement, as a companion animal with show/breeding POTENTIAL.  When this dog has received all genetic clearances (provided in writing to the breeder), and has been evaluated by the breeder as show/breeding potential, the buyer may obtain breeding rights upon payment of the sum of $500.00, plus a puppy (or price of a puppy) upon whelping. Paragraph 9 hereof shall apply.

The breeder will retain co-ownership until such time as the puppy clause has been fulfilled, or the dog has been neutered. The buyer will supply to the breeder copies of all clearances, (or proof of neutering) at which time, ownership shall be transferred to the buyer at no additional cost. The buyer is responsible for any costs of obtaining genetic clearances, or neutering. All breeding shall be pre-approved by the buyer, PRIOR to reaching any breeding agreements. Seller also retains a lifetime right to use this Newfoundland at stud at any time. These stipulation shall remain for the duration of this Newfoundland’s life.

2. The buyers will securely fence their yard (such that a puppy cannot pass through) or that a kennel run, at least 4 feet by at least 12 feet long, be constructed of chain link or other comparable fencing.  The kennel is to have shade during the summer months, and appropriate shelter for the winter.  THE PUPPY IS NOT TO BE TIED!

3.  The buyers will provide the necessary requirements for the puppy, i.e. warm, clean quarters, good nutrition, annual veterinary check-ups, protective inoculations and boosters, and other vet care as required.

4. The buyers agree that neither this puppy, nor its get, will be sold to brokers for wholesale, nor sold to pet shops or puppy mills.

5. The breeders are not responsible for any expenses incurred while the dog is in the possession of the buyer, unless previously agreed to IN WRITING.  The buyers will not hold the breeders responsible for any complications arising as a result of any anesthesia or surgical procedure performed on this puppy.

6. The breeders have had this puppy veterinary checked, and it is in good health at the time of sale. The required vaccinations and wormings are as indicated on the health record provided.

7. The breeders have had the parents of this puppy checked by their veterinarian and cleared of genetic defects.

8.  The breeders guarantee this puppy against any CRIPPLING hereditary defect.  CRIPPLING being defined for these purposes as the inability to function as a good pet and companion.  This condition must be verified by proof supplied to the breeders’ veterinarian, after written notification being given to the breeder of the condition.  If both the buyers’ and the breeders’ veterinarians concur on the condition, the breeder will either refund the purchase price, or replace the puppy, if the puppy’s condition is such that euthanasia is recommended and proof of euthanasia is supplied to the breeder. It shall be at the breeders’ discretion whether this puppy shall be replaced by a new puppy or a monetary compensation made.  The replacement or refund shall be made within twenty-four (24) months of the date of euthanasia. THIS GUARANTEE SHALL BE NULL AND VOID IF THE PUPPY HAS BEEN BRED, WHETHER INTENTIONALLY OR UNINTENTIONALLY.

9.  The parties agree that no dog covered by this contract shall be bred before obtaining appropriate health clearances, and the permission of the breeder, in writing.  If this dog has been bred without obtaining genetic clearances, and the express consent of the breeder in writing, the buyer agrees to pay the breeder the sum of FIVE HUNDRED ($500.00) DOLLARS for each puppy whelped, before the litter is six weeks of age. Any bitch bred before the age of 18 months, or any male bred before the age of 14 months, may be subject to IMMEDIATE CONFISCATION by the breeder, with all registration papers being signed back to the breeder, and no monetary compensation being made to the buyer.  This clause is contained in this contract to PROTECT the health and well being of the dog covered by it.

10.   RETURN- If for any reason whatsoever, the buyer cannot keep the puppy; it shall be returned to the breeder at no cost to the breeder, for resale, placement or disposal at the discretion of the breeder.   Any monies from resale of the puppy, less expenses to the breeder shall go to the buyer.  The buyer will deliver to the breeder, all executed registration documents, transferring ownership back to the breeder.  Any expenses incurred in transporting the dog back to the breeder or in transferring ownership back to the breeder shall be the buyer’s responsibility.

11.   If for whatever reason, legation of any nature should result concerning this Newfoundland dog both parties agree that said suit must be filed within the sellers jurisdiction. Said jurisdiction being within Marquette County Michigan 49855.   No dog covered by this contract, shall be sold, transferred, given away or euthanized without the expressed permission of the breeder IN WRITING.  Failure to obtain the written permission of the breeder may result in legal action being taken.

UNDER NO CIRCUMSTANCES IS THE PUPPY TO BE TURNED OVER TO OR PLACED IN A SHELTER, SPCA OR RESCUE SERVICE.

12.   We make every effort to grade our pups for future potential in the show ring, but any such grading must be considered an educated guess at best.  For that reason we cannot guarantee that a pup will mature to meet any show or breeding expectations.  We do guarantee that our pups are healthy, are bred from healthy stock, and will mature, with proper nutrition and care, into healthy pets of which you can be proud.

13.  This contract, and any guarantee given are not transferable.

THIS CONTRACT, AND ITS TERMS ARE FOR THE BENEFIT OF EACH INDIVIDUAL DOG UNDER IT, AND FOREMOST, TO PREVENT THE EXPLOITATION OF THE NEWFOUNDLAND BREED THROUGH UNSELECTIVE PROGRAMS AND PRACTICES.THE BUYERS AND THE BREEDERS HAVE READ THE CONDITIONS OF THE SALE, AND UNDERSTAND AND AGREE TO ALL CONDITIONS, AS INDICATED BY THEIR SIGNATURES BELOW, THIS                DAY OF                                             2007.
